βš–οΈ Your Legal Rights

  • Minimum learner allowance: Employers must pay the legislated minimum under the Skills Development Act β€” currently from R2,500/month for NQF 2-3.
  • Non-payment is illegal: Withholding stipends violates the Skills Development Act No. 97 of 1998 and your learnership agreement.
  • You cannot be dismissed for reporting non-payment to a SETA or the CCMA.
  • Your learnership contract is a legally binding agreement β€” get a copy from your employer.
  • CCMA jurisdiction: Learners are considered employees for purposes of the LRA and can approach the CCMA.

Can I be fired for reporting?

What if my employer says the SETA hasn't paid them?
